Terms & Conditions

The terms you're agreeing to.

Plain language where we can manage it, precise language where the law needs it. This covers use of the Clear Rig Compliance service and website, and includes the terms of our text-message program.

Effective 14 September 2026 Applies to clearrigcompliance.com and app.clearrigcompliance.com

01The agreement

These Terms & Conditions ("Terms") are a contract between you and Clear Rig Compliance LLC, a Washington limited liability company ("Clear Rig," "we," "us"). They govern your use of the website at clearrigcompliance.com and the software service at app.clearrigcompliance.com (together, the "Service").

By creating an account, using a link we or your employer sends you, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are accepting on behalf of a company, you confirm you have authority to bind it. If you do not agree, do not use the Service.

02What the service is — and isn't

Clear Rig is compliance-tracking software for motor carriers. It stores driver, vehicle, and company records; checks them against applicable federal requirements; tracks expiration and due dates; and sends reminders. Some plans include hands-on help from our staff in reviewing records.

The Service does not make you compliant. You do. Clear Rig does not file anything with the FMCSA or any state agency on your behalf, does not order motor vehicle records, does not run Drug & Alcohol Clearinghouse queries, and does not administer a drug and alcohol testing program. It tells you what is due and what is missing; your company remains solely responsible for obtaining, filing, and maintaining every record the law requires, and for the accuracy of the information entered into the Service.

Not legal advice. Nothing in the Service, on the website, or in communications from our staff is legal advice. Regulatory requirements change and vary by operation type. Consult a qualified attorney or compliance professional for advice about your specific situation.

Readiness indicators are ours, not the government's. Any score, status, or readiness indicator the Service displays is computed from the records in your account against our understanding of the rules. It is not an FMCSA safety rating, CSA score, or SMS result, and it does not predict the outcome of any audit, inspection, or investigation.

03Accounts and carrier responsibilities

A carrier account is opened by a person authorized to act for the carrier. That carrier is responsible for everything done under its account, including by the staff it adds. Keep credentials confidential and tell us promptly if you believe an account has been compromised.

As a carrier, you represent and agree that:

  • You have the legal right to provide every driver's and employee's information you enter into the Service, and you have obtained any consent the law requires — including, where applicable, the driver's written authorization under the Fair Credit Reporting Act before obtaining consumer reports such as MVRs or background checks.
  • Information you enter is accurate and kept current.
  • You will assign staff roles appropriately and remove access when someone leaves.
  • You are the employer and the record holder for all driver records in your account, and you will handle drivers' requests about their records in accordance with applicable law.
  • You will not use the Service to make employment decisions in a manner that violates any applicable law.

04Driver access

Your employer may send you a link to complete an application for employment or to use a driver portal for tasks such as vehicle inspection reports, document uploads, or accident reports. Those links are personal to you. Do not share them. Anything you submit through them becomes part of your employer's records, and your employer — not Clear Rig — is the party responsible for those records. Electronic signatures you provide through the Service are intended to be legally binding to the same extent as a handwritten signature.

05Acceptable use

You agree not to: access another carrier's records or attempt to; upload malicious code; probe, scan, or test the Service's security without written permission; scrape or bulk-export data other than through export features we provide; use the Service to store records for anyone other than your own drivers, vehicles, and company; impersonate anyone; or use the Service in violation of any law. We may suspend access that we reasonably believe violates these Terms.

06Fees

Plans are priced by fleet size and billed monthly: a base monthly fee plus a per-driver fee for the Starter and Growth plans, and a custom quote for the Fleet plan. Current amounts are published on our pricing page, which controls if it and this section ever differ. The per-driver fee is based on the number of active drivers in your account during the billing period.

Fees are non-refundable except where the law requires otherwise or we say so in writing. We may change pricing on renewal with at least 30 days' notice by email. If a payment fails, we may suspend the account after notice; your records remain retrievable for the retention period described in Section 11.

07Your data

You own the records you put into the Service. You grant Clear Rig a license to store, process, transmit, and display them as needed to provide the Service to you, and for no other purpose. We will not sell your data or use it for advertising. Our Privacy Policy describes what we collect, the service providers we rely on, and how long records are kept. It is part of these Terms.

You may export your records at any time using the Service's export features. Because federal regulations require carriers to retain driver records for set periods, the Service keeps prior versions of documents rather than overwriting them, and does not delete records on a schedule.

08Text-message program

These are the terms of the Clear Rig Compliance Alerts text-message program.

What we send

Time-sensitive compliance notifications to drivers. Today that means one thing: when a driver reports an accident through the driver portal and the report meets the criteria under 49 CFR Part 382 that make post-accident drug and alcohol testing mandatory, we send the driver a text with the applicable testing deadlines and instructions to contact their safety officer. We may add other compliance-deadline notifications in the future; we will not send marketing or promotional messages through this program.

Consent

Drivers receive these messages because their employing motor carrier, as a condition of the employment relationship and its own federal compliance obligations, provided the driver's mobile number to the Service during onboarding — or because the driver entered it on their application for employment. Carriers enrolling drivers represent that they are authorized to provide the number for this purpose. This is a transactional, employment-related notification program, not a marketing list.

Frequency, cost, and how to stop

  • Message frequency varies and depends on compliance events. Most drivers will receive few or no messages.
  • Message and data rates may apply. Check with your wireless carrier.
  • Reply STOP to cancel at any time. You will receive one confirmation message and no further texts.
  • Reply HELP for help, or email support@clearrigcompliance.com.
  • If you opt out, the Service will continue to notify your employer through other channels when a deadline applies to you. Your employer remains responsible for informing you of federal testing requirements.
  • Wireless carriers are not liable for delayed or undelivered messages.

Our Privacy Policy describes how phone numbers are handled. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

09Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CLEAR RIG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT REMINDERS WILL ALWAYS BE DELIVERED OR DELIVERED ON TIME, OR THAT USE OF THE SERVICE WILL RESULT IN COMPLIANCE WITH ANY LAW OR A PARTICULAR OUTCOME IN ANY AUDIT, INSPECTION, OR INVESTIGATION.

10Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLEAR RIG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY FINES, PENALTIES, LOST PROFITS, LOST REVENUE, OR LOSS OF OPERATING AUTHORITY, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. CLEAR RIG'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO CLEAR RIG IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

11Term and termination

These Terms apply for as long as you use the Service. You may close your account at any time by contacting us. We may suspend or terminate an account for material breach of these Terms after notice and a reasonable chance to cure, or immediately if the breach threatens the security of the Service or other customers.

After termination, you may request an export of your records. We will retain records for the remainder of any applicable federal retention period unless you instruct us in writing to delete them and the law permits deletion. Sections 7, 9, 10, 12, and this section survive termination.

12Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state courts located in Pierce County, Washington, or in the United States District Court for the Western District of Washington, and you consent to the personal jurisdiction of those courts. Before filing, each side agrees to try to resolve the dispute informally by contacting the other and allowing at least 30 days for a response.

13Changes to these terms

We may update these Terms. If a change is material, we will notify carrier customers by email at least 14 days before it takes effect and update the effective date at the top of this page. Continued use after that date means you accept the change.
